Agreement to these terms

These Terms of Service govern your use of the Mindex Studio website (mindexstudio.com), the Mindex Studio platform (app.mindexstudio.com), and the services we provide. By using our website, creating an account on the platform, or engaging our services, you agree to these terms. Mindex Studio is operated from Sydney, NSW, Australia.

The services

• Growth, marketing and AI implementation services delivered under individual service agreements
• The Mindex Studio platform: an AI marketing workspace that connects to your own accounts on third-party platforms (such as Meta, Shopify and Google) to analyse performance, generate creatives, and create and manage advertising campaigns on your behalf

Your account

• You are responsible for the credentials you use to access the platform and for all activity under your workspace
• You must provide accurate information and keep it up to date
• You must be authorised to act for the business whose accounts you connect

Connected third-party accounts

The platform acts on third-party accounts only after you connect them and authorise access, and only within the permissions you grant.

• You may disconnect any third-party account at any time, in the platform or in the third party's own security settings
• Actions taken on connected accounts at your direction (for example, creating an ad campaign) are taken on your behalf and remain your responsibility, including the advertising budgets you set
• Your use of each connected platform remains governed by that platform's own terms, including Meta's Commercial Terms and Advertising Standards where applicable

Acceptable use

• No use that violates any law, regulation, or the policies of a connected platform
• No advertising that is deceptive, discriminatory, or prohibited by the platform it runs on
• No accessing accounts or data you are not authorised to access
• No interfering with, probing, or disrupting the platform or its security

Content and intellectual property

• You retain ownership of the content and data you bring to the platform
• Creatives generated for you through the platform are yours to use for your business
• The platform itself, including its software, design and branding, remains the property of Mindex Studio

Fees

Services are billed as agreed in your service agreement or plan. Advertising spend on connected platforms is charged by those platforms directly to your own payment methods and is separate from our fees.

Disclaimers and liability

The services are provided with reasonable skill and care. To the extent permitted by law, including the Australian Consumer Law:

• We do not guarantee specific marketing results, advertising performance, or platform availability
• We are not liable for decisions taken by third-party platforms, including ad review outcomes, account restrictions, or API changes
• Our aggregate liability for any claim is limited to the fees you paid us for the service giving rise to the claim in the three months before it arose

Termination

You may stop using the platform and disconnect your accounts at any time. We may suspend or terminate access for breach of these terms. Clauses that by their nature should survive termination survive it.

Governing law

These terms are governed by the laws of New South Wales, Australia, and disputes are subject to the courts of New South Wales.

Changes to these terms

We may update these terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the services after changes are posted constitutes acceptance.
